Augmedix is committed to protecting your privacy. This Privacy Policy describes how Augmedix, Inc., its subsidiaries and affiliates (referred to as a group as “Augmedix” or “we” or “us” or “our” or “Company”) collect, use and disclose information that we obtain about visitors to our website (“Site”) and users of the Augmedix’s medical documentation services and mobile applications (“Services”). It also describes how we protect your personal information and how you can contact us with any questions. Before using this Site or the Services, or otherwise providing us with your information, please review this Privacy Policy carefully.

OUR HEALTHCARE BUSINESS SERVICES

Augmedix is on a mission to help clinicians and patients form a human connection by seamlessly integrating our technology at the point of care. Augmedix’s proprietary platform digitizes natural clinician-patient conversations, which are converted into comprehensive medical notes and structured data in real time. The company’s platform uses automatic speech recognition, and natural language processing, including large language models, to generate accurate and timely medical notes that are transferred into the EHR. When we provide these Services for our customers and their Authorized Users, we are subject to a federal medical privacy law called the Health Insurance Portability and Accountability Act (“HIPAA”). Customers of our Services must agree to additional terms in order to use our Services in compliance with HIPAA, which law’s protections apply to all patient information we access as part of our Services. Thus, this Privacy Policy does not apply to the patient information we may process in connection with providing the Services. Our treatment of patient information is governed by HIPAA and our agreements with our customers, including our subscriber agreement and a business associate agreement, as applicable.

We do not have direct relationships with the patients of our customers. If we receive any inquiries or requests from such patients about their information, we will direct those inquiries or requests to the relevant customer.

PERSONAL INFORMATION

Personal information means information that specifically identifies you as an individual or that can be used to identify an individual, such as your email address, physical address, telephone number etc. (“Personal Data”). Personal Data does not include “aggregate” information which we aggregate from information (including Personal Data) you provide to us. Information that has been de-identified or aggregated by Augmedix or others is no longer Personal Data and is not covered by the terms of this Privacy Policy.

INFORMATION YOU PROVIDE

Augmedix collects Personal Data in a variety of ways, including, but not limited to, when individuals contact us through our Site, respond to a survey or fill out a webform, or when users of our Services make such information available in connection with the Services.

When you interact with us through our Site, you may choose to provide us with Personal Data via this Site. For example, you may use our web form to submit questions to us about potential business or professional opportunities or product updates. Our form for these inquiries collects name, address, email address, and other information you choose to submit. You may also choose to email us through the Site, in which case we will receive your name, email address, and other information you include. As described in our Terms of Use, please do not send us confidential information through our website.

In addition, customers and their users of our Services may log into a password-protected portal (area) in our Site in order to seek technical support and handle other administrative matters. We use information collected through this portal to communicate with our customers and their users about administrative matters and technical support issues. We may aggregate and/or anonymize this information to improve our Services. Customers and their users are not permitted to send patient medical information (called Protected Health Information under HIPAA) through this administrative and support portal.

Augmedix may also collect Personal Data about Authorized Users when they submit it or make it available in connection with our Services. Further, whenever a user uses the Services, we may use a variety of technologies that automatically or passively collect information about how you access and use the Services.

By voluntarily providing us with Personal Data, whether through our Site or in connection with the Services, you are consenting to our use of it in accordance with this Privacy Policy.

PERSONAL INFORMATION WE COLLECT AND YOUR CHOICES

We do not collect Personal Data when you visit our Site unless you choose to provide it to us. If you send us questions and/or let us know that you would like updates about Augmedix, we may respond to your questions and/or send you news about company developments or product updates from time to time. If you do not wish to receive further publications or emails, please contact us via email. We use Personal Data collected through our Site only for purposes consistent with the reasons you provided it.

NON-PERSONAL INFORMATION WE COLLECT

We collect non-personal web usage information about visitors to our Site. This may include information related to consumer activity on the Site (usage details); data collected includes IP addresses, operating systems, browser types, pages you visit and Site traffic data. We may also use cookies, web beacons, and/or third-party web analytic tools to analyze Site traffic.

Cookies are small text files or data placed by your web browser on your hard drive to store information that allows a website to recognize whether a certain computer or device has been used to visit the Site in the past. Cookies enable websites to keep track of online patterns and preferences and make the personalization of web experiences possible. You can adjust your browser settings to remove or block cookies. A web beacon is a graphic on a web page or in an email that gathers non-personal web log information about pages visited or emails opened. Web analytics services record non-personal data such as browser type, operating system, the date and time of a visit, where visitors came from, the pages visited on this Site, the time spent viewing Site, where visitors went, when they left the Site, and return visits to the Site.

We may aggregate this non-personally identifiable data to better understand how visitors use our Site, to customize a customer or visitor experience, and to help manage, maintain, and report on the use of our Site. We may store IP addresses for fraud detection and prevention purposes.

SOCIAL PLUG-IN DATA

The Augmedix Site may use interfaces with social media websites like Facebook, LinkedIn, X (formerly Twitter), Instagram, YouTube, and others. If you choose to “like” or share information from the Augmedix Site through these services, you should review their privacy policies. If you are a member of a social media website, the interfaces may allow the social media website to connect your website visit to your personally identifiable information.

USE OF PERSONAL INFORMATION

Augmedix may use the information collected from you when you use our Site or Services for various purposes as permitted by applicable law. These include, without limitation:

  • to create and manage your account;
  • to provide the Services or information you request;
  • to follow up with you regarding your interest in and/or use of the Services;
  • to process orders or other transactions; billing and payments
  • to keep you informed about the status of your Services;
  • to identify your preferences so Augmedix can notify you of information, products, services, and promotions that might be of interest to you;

  • to improve customer service and the overall experience with Augmedix;

  • to generate and analyze statistics about the preferences of users of our Services;
  • to detect, prevent, and respond to fraud, intellectual property infringement, violations of our Terms of Use, or violations of the law;
  • to comply with applicable laws, regulations, and legal process; and
  • to communicate with and advertise to users of the Services and others by email, postal mail, telephone, or other means.
INFORMATION WE SHARE

If you provide Personal Data to us via the Site, we may share it with service providers who assist us in activities such as technology or communications management. These providers are not authorized to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements. We will not share Personal Data about you with third parties for their marketing purposes. We might share Personal Data if we were to sell or transfer all or a portion of our business or assets, in which case we would make commercially reasonable efforts to contractually require the recipient to treat the information in accordance with this Privacy Policy. We might also disclose information about you (i) if required by law, subpoena, court order, or legal process, (ii) to law enforcement or other government authorities, or (iii) if we believe disclosure is necessary or appropriate to prevent serious physical harm or in connection with an investigation of illegal or fraudulent activity.

We may also disclose personal data to third parties that help us provide the Services or perform certain business functions on our behalf.

We do not sell Personal Data for monetary or other valuable consideration.

PROTECTING PERSONAL INFORMATION

We are committed to maintaining the security of Personal Data. We use appropriate administrative, technical, and physical security measures intended to protect against loss, misuse, improper access, disclosure, alteration, or destruction of Personal Data. If we share Personal Data with third parties to provide services to us, we will contractually require them to employ appropriate security measures to protect it.

LINKS TO OTHER SITES

We may provide links to other websites for your convenience and information, but we do not operate these websites and are not responsible for their privacy practices or content. Please contact those websites directly if you have any questions about their practices.

INTERNATIONAL DATA TRANSFERS

We may transfer your Personal Data to our offices or service providers in various countries, including to jurisdictions not deemed “adequate” by European Union governmental bodies. Please do not provide us with any information that you do not wish to be transferred internationally.

“DO NOT TRACK” SIGNALS

The Site does not respond to web browser “do not track” signals. Accordingly, even if you select a “do not track” option on your browser, your navigation of the Site may be tracked as part of the collection of visitor information described above.

NOTICE TO CALIFORNIA RESIDENTS

Augmedix provides California residents the privacy rights listed below in accordance with the California Consumer Privacy Act (“CCPA”):

The Right to Know. You have the right to request to know: (i) the specific pieces of Personal Data we have about you; (ii) the categories of information we have collected about you in the last 12 months; (iii) the categories of sources from which such information is collected; (iv) the purpose for collecting and selling your information; and (v) the categories of information about you that we sold or disclosed in the last 12 months.

Categories of Information Collected by Augmedix. Augmedix collects the following categories of information from our Site or to otherwise provide our Services: identifiers (e.g., email address, username, IP address or other similar identifiers); Personal Information categories under the California Customer Records statute (Cal. Civ. Code § 1798.80(e))(e.g., name, postal address, phone number, payment card information); internet or other similar network activity (e.g. browsing history, search history, information on a consumer’s interaction with website or application); information collected through automatic data collection technologies (i.e., Site usage detail, such as IP addresses, operating systems, browser types and website traffic); professional or employment related information (i.e., current or past job history or performance evaluations); inference data (e.g., personal profiles reflecting preferences).

Purpose of Information Collected by Augmedix. We collect your information for recruitment, employment, marketing and other business purposes. Augmedix may obtain information either directly from you (e.g., through forms you complete on our website or the setup of your user account) or indirectly from you (by tracking actions that you take on our website or mobile applications). We may also obtain information from third-party vendors who perform business services on our behalf.

Uses of Information Collected. Augmedix has used the following categories of information and Personal Data: Identifiers; Categories of Personal Data under the California Customer Records statute; Internet or other similar network activity; and inference data. We use your information for the following business purposes: to operate and improve our business; to fulfill the purpose for which the information was collected (e.g., to provide Services or personalize communication); to maintain, customize, or improve the quality of our Services and Site; to recruit personnel; and detecting and investigating fraud and other illegal activities.

Sharing Personal Information. Augmedix has disclosed the following categories of Personal Data for a business or commercial purpose: Identifiers; Categories of Personal Data under the California Customer Records statute; Internet or other similar network activity; and Inference Data. We may disclose your information and Personal Data, for a business purpose, to service providers, our partners or affiliates, or third parties with whom we collaborate to provide our Services. Please note that Augmedix does not sell your Personal Data.

The Right to Access. You have the right to request access to your Personal Data that Augmedix has collected over the past 12 months.

The Right to Deletion and Correction. You have the right to request that we delete or correct the information and Personal Data that we have collected or maintain about you. We may deny your request under certain circumstances, such as if we need to comply with our legal obligations or complete a transaction for which your Personal Data was collected. If we deny your request for deletion, we will let you know the reason why.

Personal Information Sales and Share Opt-Out

We do not sell your Personal Data. You have the right to direct us not to share your information and Personal Data at any time (the “Right to Opt-Out”). You may indicate your choice to opt-out of the sharing of your information and Personal Data with third parties for personalized advertising by contacting us as set forth below.

 The right to equal service. If you choose to exercise any of these rights, Augmedix will not discriminate against you in anyway. If you exercise certain rights, understand that you may be unable to use or access certain features of Augmedix’s  Services.

Verification. We will take steps to verify your identity before processing your request to know, access, opt-out or request to delete or correct. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected Personal Data. If you have an account with us, we will use our existing account authentication practices to verify your request. If you do not have an account with us, we may request additional information about you. We will only use the Personal Data provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose.

Authorized Agent. You may use an authorized agent to submit a request to know or a request to delete. When we verify your agent’s request, we may verify both your and your agent’s identity and request a signed document from you that authorizes your agent to make the request on your behalf. To protect your Personal Data, we reserve the right to deny a request from an agent that does not submit proof that they have been authorized by you to act on their behalf.

CHILDREN

The website is intended for use by adults. We do not knowingly collect any Personal Data from children under the age of 13 without parental consent, unless permitted by law. If we learn that a child under the age of 13 has provided us with Personal Data, we will delete it in accordance with applicable law.
